The City of Miami Beach currently considers short term rentals of residential properties on Miami Beach as commercial use of the property, which is not allowed in areas zoned RS-1, RS-2, RS-3 or RS-4. A short term rental is defined as a rental for a period of less than six months and one day. All rentals of such properties must conform to the Zoning Requirements of the City of Miami Beach as currently interpreted by the appropriate regulatory authorities.
Notice: It is necessary to clarify the use of our services. WeOwnSouthBeach is a hospitality service provider and the complimentary suites offered and listed within this site are not available for rent or lease by any means. WeOwnSouthBeach offers its Guests the use of its hospitality suites complimentary and all clients are and will be considered Guests of WeOwnSouthBeach. All payments made to WeOwnSouthBeach, WOSB LLC and/or its affiliates under this Occupancy Agreement shall be for concierge services rendered by Guest only.
1. WeOwnSouthBeach hereby allows Guest for not more than time initially requested the exclusive use of the follows Hospitality Suite unit located at The Flamingo; 1500 Bay Road, Miami Beach, FL 33139, hereinafter referred to as “Hospitality Suite”.
2. This Agreement shall be for a term commencing on Guest’s reserve date with a check-in at 2:30pm and terminating at 10:30am on the reserved check-out date. (Not to be used by anyone but client and said guests, this agreement is non-transferable). Late-Checkout requests will be considered on the final day of Guest’s reservation only.
3. The terms and conditions of this Occupancy Agreement shall be considered null and void if not fully agreed to.
4. WeOwnSouthBeach shall at its own expenses provide the following utilities or services.
a) Basic Utilities; Electric and Water (up to normal monthly spending).
b) High Speed Internet Connection
c) Digital Cable TV
d) Interior Maintenance Services (Plumbing, electrical, etc.)
e) The cleaning service WeOwnSouthBeach provides is rendered after Guest’s departure at a charge of $100.00 for 2.5 hours of work. Additional cleaning may be required at $25.00/hour.
5. Guest Further Agrees:
a) Upon the expiration of this Agreement, the Hospitality Suite being occupied shall be returned in its present condition, with minimal wear and tear accepted.
b) WeOwnSouthBeach provides an Insider’s Guide to the WORLD FAMOUS SOUTH BEACH where you will “Get the Most out of your Stay.” To assist you in experiencing the many services offered, WeOwnSouthBeach will provide you with a complimentary stay at one of our Hospitality Suites.
This is not a rental/lease agreement; you are not given any legal right to be on this property aside from your scheduled dates. An extension of your occupancy requires written permission from WeOwnSouthBeach. All monies collected are for Concierge Services only.
c) The Guest designated to execute this Agreement understands and agrees to make all occupants and visitors aware of the terms, conditions and acknowledgements associated with the occupancy of the Hospitality Suite. Said Guest assumes unconditional responsibility and full liability from any cause or action resulting from occupants and visitors who are not in full agreement, nor unconditionally accepts all such terms, conditions and acknowledgements. Said Guests further agrees to deny access to the reserved Hospitality Suite and/or property access to any such person(s).
d) Guests shall permit WeOwnSouthBeach and/or their staff to enter the Hospitality Suite at any reasonable time for any reasonable purpose including but not limited to; repair, improvement, maintenance and/or management of the Hospitality Suite.
e) All Guests indemnifies and hold harmless WOSB LLC, WeOwnSouthBeach, its firm, staff and associates free and clear of any claims, suits, expenses and liabilities arising from personal injury, property damage or wrongful death occurring in or around the above referenced Hospitality Suite at any time during the terms of this Agreement, which was a direct or indirect result of Guest’s own wrong-doing and/or negligence.
f) All Guests agree to utilize their own Renters, Travel and Medical Insurance. Guests agrees to indemnify, release and hold harmless WeOwnSouthBeach, WOSB LLC, its firm, staff, agents, associates and suppliers from any accidents or incident due to the wrong-doing or negligence of the Guest. The Guest(s) shall check the Hospitality Suite for any hazardous areas that may not be fitting for children, including supervising pool activity since a life guard will not be present. Please be advised that Guest is responsible for all medical emergencies, drowning, slip and falls, any and all other injuries that may occur during your occupancy.
g) All Guests shall make children aware of the Hospitality Suite and common area rules and regulations. Unsupervised children will not be the responsibility of WeOwnSouthBeach to any extent.
h) Reservations made for minors, teenagers, and/or young groups will not be honored without an accompanying adult/chaperone staying in the unit at all times and as such are covered by Florida Statute 509.141, Refusal of Admission and Ejection of Undesirable Guest. Accordingly the parties agree and consent that conduct which falls under the parameters of said law should be a sufficient cause for the ejection of the underage Guests by a law enforcement officer.
i) Guest acknowledges that all furnishings and contents contained in the Hospitality Suite are in new and/or good condition, and those Guests shall maintain them in such condition, and shall be responsible for all damage thereto. Should Guests discover any damage or defects to the Hospitality Suite or furnishings, the Guests within twelve (12) hours of taking occupancy shall deliver specifics to a WeOwnSouthBeach representative by written notice or email thereof. Unless such notice specifying defects and/or damage is delivered to WeOwnSouthBeach, the retaining of the Hospitality Suite’s possessions shall be conclusive evidence that the Hospitality Suite was in good and satisfactory condition at the time such possession was taken. An inventory of the contents of the Hospitality Suite (including furniture, furnishings, bedding, appliances, electronics, etc.) is hereto made a part of the agreement and can be provided to Guests upon request.
j) In the event the Hospitality Suite and/or its Property is damaged or affected by fire, water or other unavoidable casualty (natural disasters, hurricanes, flood, etc.) as to be unfit for occupancy, at the discretion of a WeOwnSouthBeach representative, this agreement may be terminated, providing that all funds paid are refunded.
k) WeOwnSouthBeach will not be responsible for any personal belongings and/or items of value left behind in the Hospitality Suite and/or its premises. The Guest agrees that if contents are found, a WeOwnSouthBeach representative will gladly ship it to the Guest at his/her’s expense.
l) This agreement shall have no force or effect unless both parties have executed and delivered a completed and signed agreement to the other. All transmissions received through facsimile and/or scans shall be considered for all purposes as originals.
m) Pets are allowed in the Hospitality Suite when specifically approved in advance in writing by a representative of WeOwnSouthBeach.
n) If more than 8 people occupy the Hospitality Suite at one time, it must be cleared in writing with a representative of WeOwnSouthBeach
o) Guests shall comply with all building, zoning, and health codes and other applicable laws.
p) Guests shall not conduct any activity deemed hazardous, a nuisance, a disturbance, or requiring an increase in insurance premiums, nor conduct any illegal, immoral or improper activity anywhere on the property. All guests shall not allow or permit any disturbance, excessive noise, or any annoyance whatsoever.
6. Upon default or expiration of the this Occupancy Agreement whichever occurs first, all Guests and Visitors shall quit and surrender the Hospitality Suite hereby demised in a clean and presentable condition, in same good condition as it was received at the commencement of this Agreement. Guest may receive at the WeOwnSouthBeach representative’s discretion, a late Check-Out extension not to exceed three (3) hours. In the event that Guest stays past the allowed Check-Out deadline, Guest agrees to pay a $50/hour fine for each hour past the deadline time and will be responsible for any re-arrangements required for next expected Check-In Guest if any.
7. In the event that any action is brought against WeOwnSouthBeach, WOSB LLC its firm, staff and/or associates as a result of Guest’s occupancy, the Guest shall be personally liable for all costs incurred by WeOwnSouthBeach, WOSB LLC its firm, staff and/or associates including but not limited to, any remedies or judgments which may be awarded, as well as, reasonable attorney’s fees.
8. All towels and linens are to be picked up prior to departure and placed in one location. If any of the contents of the Hospitality Suite is dirty, stained or soiled, and professional cleaning is required, the total cost will be deducted from the service deposit; this includes but not limited to furniture, decorative pillow, bedding and rugs.
9. Refundable Service Deposit –A $500 deposit will be held by WeOwnSouthBeach as an option to offset any damages to the Hospitality Suite or property as a direct result of Guest’s occupancy. The amount used to pay for any damages will be determined at the WeOwnSouthBeach representative’s reasonable discretion. Damage receipts for items or repairs will be supplied to the Guest by WeOwnSouthBeach WOSB LLC, its firm, staff and/or associates as proof of repair or replacement. In the event that damages exceed $500, Guest personally warrants being responsible for the excess loss and guarantees to pay WeOwnSouthBeach within 30 days of establishing a determined amount. In the event that Guest feels WeOwnSouthBeach, WOSB LLC its firm, staff and/or associates are not reasonable in its determination of damage amounts, Guest may, at Guest’s sole expense, pay for Appraisal (Said Appraiser must be approved by the WeOwnSouthBeach team at its discretion) to determine the amount of damages. Any excessive work and/or time involved in restoring the Hospitality Suite to its usual condition will be subject to a $15 hourly rate. This rate is not inclusive of any other professional services that may be required. In the event there is no damage to property, WeOwnSouthBeach shall refund said $500 deposit or refund back to credit card, the day of checkout. A WeOwnSouthBeach representative will assist you in the Check-out process and personally refund your service deposit once a walk through of the Hospitality Suite is complete.
10. NON SMOKING SUITES – This is a non-smoking Hospitality Suite for many reasons. Primarily to prevent the Hospitality Suite’s décor, art, furnishings, and general contents from absorbing the odor and discoloring effects resulting from the bi-products in cigarettes and cigars. If smoked in, the WeOwnSouthBeach representative will have the right to evict all Guests from the Hospitality Suite immediately. Please understand that this is a large part of the agreement and will be binding. You will lose your deposit in full if this clause is breached. Guest may smoke on the balcony only.
